Avoiding Foreclosure
The foreclosure process can be exceedingly complex and time consuming, particularly for a person who has little or no legal experience or knowledge regarding Florida foreclosure proceedings. The Florida foreclosure process will begin with a “notice of default” when the lender notifies you that you are in default of your mortgage. You have fallen behind enough that the lender is beginning foreclosure proceedings.
The lender will then file a Lis Pendens, which is a “suit pending.” This is a lawsuit against you for your being in default, and it demands that you pay the mortgage in full. The Clerk of Court will record the Lis Pendens and you will be served.
You will then have 20 days to file an answer with the court in regards to the foreclosure. By filing an answer, you will then have the opportunity to represent your side at a hearing overseen by a judge.
If you are unable to successfully contest the foreclosure, or work out a loan modification or short sale, the judge will set a foreclosure sale date which will usually be approximately 30 to 45 days following your hearing. This is when the property will be sold.
After the property sells, you no longer have the right to your property. You cannot pay off the mortgage and save your house or take any other option, unless proper procedures regarding the foreclosure and sale of the home were not followed for some reason.
